====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 03-03-2021 Heard learned counsel for the petitioner and learned A.P.P for the State.

It is submitted by learned counsel for the petitioner that the order dated 03.02.2021 passed in this case has been complied with and a supplementary affidavit has been filed. This application has been filed for modification of the order dated 25.02.2020 passed in Cr. Misc. No. 898/2020 wherein while granting anticipatory bail to the petitioner in connection with Barauli P.S. case No. 323 of 2019, the petitioner had been directed to surrender in the learned court below within six weeks. The petitioner by way of modification prays for extension of time for surrendering in the learned court below.

Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.8058 of 2021(4) dt.03-03-2021 2/2 specially in view of the contents of the supplementary affidavit, the Court is inclined to allow the instant modification application. The order dated 25.02.2020 (Annxure 1) passed in Cr. Misc. No. 898/2020 is modified to the extent that the time/period granted to the petitioner to surrender in the court below is extended by a further period of 6 weeks from today. On his so surrendering, the petitioner shall be enlarged on bail in connection with Barauli P.S. Case No. 323/2019 pending in the court of learned 2nd Additional Sessions Judge - cum - Special Judge, Excise, Gopalganj.

Remaining part of the order dated 25.02.2020 (Annxure 1) passed in Cr. Misc. No. 898/2020 shall remain the same.
