JUSTICE BIRENDRA KUMAR ORAL ORDER 21-01-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Biraul P.S. Case No. 481 of 2017 registered for the offence punishable under Section 461/379 of the Indian Penal Code.
Petitioner is suspected to have stolen away coins from the shop of the informant in the nights.
Submission is that there is no direct evidence. None has seen the petitioner committing theft. For business rivalry with the informant, false case have been lodged. In view of the aforementioned facts, the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of
Patna High Court Cr.Misc. No.66534 of 2018(4) dt.21-01-2019 2/2 receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Biraul Darbhanga in connection with Biraul P.S. Case No. 481 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
