23-09-2016 The petitioner apprehends his arrest in relation to Govindpur P.S. Case No. 34 of 2016, registered under Sections 379 of the Indian Penal Code as well as Section 40 of the Bihar Minor Mineral Concession Rules, 1972 and Section of Bihar Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2003.
The case has been instituted in violation of the aforesaid Rules in relation to the mining and carriage of sand which was not permissible. Petitioner has been made accused and happens to be the owner of Tractor in which sand was being carried. He was not at the site.
Be that as it may, in the event of his arrest/surrender before the court below within four weeks, let the above named petitioner, namely, Babu Charan Prasad, be enlarged on bail on furnishing bail
Patna High Court Cr.Misc. No.41754 of 2016 (2) dt.23-09-2016 bonds of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada, in connection with Govindpur P.S. Case No. 34 of 2016, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
