JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-11-2017 The petitioner seeks regular bail in connection with Dhansoi P.S. Case No. 98 of 2017, registered for offences punishable under Sections 302 and 120(B) and 34 of Indian Penal Code.

Allegation against the petitioner and other accused person is of stabbing the deceased to death.

It has been submitted on behalf of the petitioner that petitioner is own nephew (bhagina) of the husband of the deceased and has falsely been implicated in this case and nobody has seen the occurrence and he has been in custody since 19.07.2017. Learned counsel for the State as well as informant opposed the prayer for bail and submitted that witnesses have supported the case of prosecution and has seen the accused

Patna High Court Cr.Misc. No.49090 of 2017 (3) dt.09-11-2017 persons fleeing away from the place of occurrence. Having heard both sides, considering the fact and circumstances of the case and nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, dismissed.
