JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-07-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 420, 468 and other ancillary sections of the Indian Penal Code.

Learned counsel for the petitioner submits that as per the prosecution case, co-accused Baijnath Das collected Rs.5 lacs per candidate and handed over the same to co-accused Chataranjan and co-accused K.K.Sharma for providing job and this petitioner is alleged to be present with said co-accused K.K.Sharma and there is no allegation that the petitioner took the said money or gave assurance to the applicants for providing them job.

Considering the aforesaid facts of the case, prayer for

Patna High Court CR. MISC. No.52385 of 2021(4) dt.14-07-2022 2/2 bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IV, Darbhanga in Simri Police Station Case No. 61 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
