The Magadh University & Others and contended that identical issue was the subject matter of the said writ petition and initially the said case was also running along with the present cases but these three cases were admitted whereas the other case was dismissed by the aforesaid judgment.
3. Learned counsel for the petitioners submitted that against the said dismissal, L.P.A. No. 1586 of 2015 has been preferred in which by order dated 20.02.2018, the matter has been fixed for 6th March, 2018.
4. Be that as it may, once the co-ordinate Bench has
Patna High Court CWJC No.15619 of 2011 dt.28-02-2018 3/3 decided the identical issue by a reasoned order, the Court finds that the matter does not require to be kept pending at this stage. 5.
Accordingly, following the judgment dated 29.04.2015 passed in C.W.J.C. No. 19555 of 2011 in the case of Raghav Prasad Vs. The Magadh University & Others, the present writ petitions also stand dismissed.
6. However, it goes without saying that the parties shall be at liberty to take appropriate action, in accordance with law, depending upon the outcome of L.P.A. No. 1586 of 2015. (Ahsanuddin Amanullah, J) Anjani/- AFR/NAFR U
