The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.
The daughter of the informant was married with this petitioner ten years back. The petitioner had two children aged about eight years and five years respectively. Allegation is of demand of dowry and torture for the same, as a result whereof, dowry death was committed.
Submission of the petitioner is that there is no eyewitness of the occurrence nor presumption of dowry death is there. Moreover, just to pressurize, after death of the victim, the present
Patna High Court Cr.Misc. No.50501 of 2016 (3) dt.28-01-2017 2/2 false case has been lodged.
Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Patnacity/successor Court in connection with Khajekalan Police Station Case No. 295 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
