Petitioner apprehends arrest in a case registered for the offence punishable under Sections 147, 327 and other allied sections of Indian Penal Code and Section 27 of Arms Act. As per prosecution case, this petitioner along with 24 other FIR named accused persons fired upon one other group and tried to loot the crops.
Learned counsel appearing for the petitioner submits that though there is allegation of firing but no one sustained fire arms injury. It is next submitted that the petitioner is of different village and has got no concern with the group members of village Malpur. There is no specific overt act against this petitioner.
Considering the aforesaid facts and circumstances, let
Patna High Court CR. MISC. No.42870 of 2022(2) dt.01-12-2022 2/2 the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Barh in Ghoshwari P.
