JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-09-2016 Heard learned counsels for the petitioner and the State. The petitioner being the mother of the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 376/511 and 498A of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.

The basic accusation is of torture for non-fulfillment of the dowry demand. It is also alleged that the accused persons made assault to the informant at the behest of the husband of the informant when co-accused Ainul @ Laddan Ansari, the younger brother of the husband of the informant attempted to establish forceful physical relationship.

It is submitted by the learned counsel for the petitioner that the accusation is omnibus and general against the entire in-

Patna High Court Cr.Misc. No.39525 of 2016 (2) dt.09-09-2016 2/2 laws family including the petitioner. Thrust of accusation is against the husband of the informant. There is no injury report on record and the petitioner is an old lady.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, West Muzaffarpur in connection with Baruraj P.S. Case No. 68 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
