2. The petitioner has preferred this application for grant of regular bail in connection with Sessions Trial No. 86A/2023 arising out of Siswan P.S. Case No. 179/2020 dated 13.08.2020 registered for the offences punishable u/ss 147, 341, 323, 302, 120B of the Indian Penal Code.
3. As per the prosecution case, the co-accused persons caught hold of the informant's son and the co-accused Sonu Kumar Singh and Mithilesh Kumar Singh (petitioner) inflicted knife blow in the abdomen of the son of the informant and due to that he died.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.41005 of 2025(2) dt.27-08-2025 2/2 that the petitioner is innocent and has falsely been implicated in this case. As per the postmortem report, only one sharp cut injury has been found on the deceased. Similarly situated coaccused has already been granted bail by this court vide order dated 24.07.2023 passed in Cr. Misc No. 39393 of 2023. The petitioner has two criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 26.09.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that there is direct allegation against the petitioner of inflicting blow of knife to the informant's son due to that he died on the spot.
6. Considering the aforesaid facts and circumstances of the case as well as the specific and heinous nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail.
7. The application stands rejected.
