This application is for grant of regular bail in connection with Agamkuan P.S.Case No.304/2017 for the offences punishable under Sections 390/34 of the Indian Penal Code and Section 3 (1), 3 (2)/4/5/6 and 7 of the Immoral Traffic Act.
Allegation against the petitioner is of running immoral trafficking and he was arrested on the spot. It further appears from the petition that he is accused in five other cases out of which four cases relates to immoral traffic Act. Submission of the learned counsel for the petitioner is that he has been falsely implicated in this and nothing has been found to show that he is running immoral tracking.
Patna High Court Cr.Misc. No.50595 of 2017 (2) dt.13-11-2017 2/2 Heard learned A.P.P. also, who has opposed the prayer for bail stating that the FIR itself shows that the other persons who were arrested on the spot have stated that he is running immoral trafficking and he is accused in other cases also. Having heard both sides and in view of facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, as he is in custody, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months and if possible conduct it on regular basis.
The Sr. S.P., Patna is directed to ensure presence of the witnesses in this case before the court concerned so that the trial may be concluded within the period as specified. With the aforesaid observation, this application is dismissed.
