JUSTICE SUDHIR SINGH ORAL ORDER 24-11-2016 The supplementary affidavit has been filed on behalf of the petitioner. The same may be kept on the record. Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Chapra Town P.S. Case No. 282 of 2015, arising out of complaint case no. 2474 of 2015 for the offences instituted under Sections 120B, 420, 467, 468 and 471/34 of the Indian Penal Code.

The allegation against the petitioner is of giving evidence before the Registering authority which is being alleged to be false.

It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.47643 of 2016 (4) dt.24-11-2016 2/2 petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is said to be the witness on the deed of gift. No wrongful loss has been alleged against the petitioner. The said deed of gift is already a subject matter of the Title Suit No. 456 of 2015, which is pending in the court below. The other co-accused has been granted bail vide Cr. Misc. No. 26524 of 2016. The matter relates to the civil dispute.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today, in connection with Chapra Town P.S. Case No. 282 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Divya Prakash, learned Judicial Magistrate 1st Class, Saran at Chapra, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
