The petitioner seeks bail in connection with Chandi P. S. Case No.496 of 2020, instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.
The learned counsel for the petitioner submits that the petitioner is in custody since 18.03.2021, charge-sheet has been submitted in the case and has antecedent of four cases. The learned counsel for the petitioner submits that supplementary affidavit has been filed wherein it has been specifically recorded and pleaded that out of four cases, three cases were instituted by the side of the present informant against the petitioner. The learned counsel submits that allegation is of

No.53575 of 2021(3) dt.03-03-2022 2/3 firing by the petitioner hitting left hand of the informant while other accused assaulted him by lathi, danda and rod and the reason for the occurrence is that the petitioner and the other accused were pressurizing the informant to compromise the case.
The learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that though it is alleged that the occurrence took place, the petitioner was pressurizing the informant to compromise the case. The F.I.R. is completely silent as to what was the nature of the case which case, the petitioner was pressurizing to compromise. It is submitted that there is absolutely no detail of the case, only a bald allegation has been levelled. It is further submitted that the injury caused by firearm is on the little finger of the informant which is said to be grievous, but that is not on the vital part of the body.
The learned A.P.P. for the State opposes the bail application.
Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and taking into consideration the submissions made by the learned counsel for the petitioner, the petitioner, above-named, is directed to be

No.53575 of 2021(3) dt.03-03-2022 3/3 released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Hilsa, Nalanda in connection with Chandi (Nalanda) P. S. Case No.496 of 2020, subject to condition that one of the bailors shall be the father of the petitioner namely, Krishna Gope. The application stands allowed.
