JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State, but no one appeared on behalf of O.P.No.2. The petitioner apprehends his arrest in connection with Mali P.S. Case no. 36 of 2016, registered under Sections 498(A) of the Indian Penal Code and 3/4 of Dowry Prohibition Act. Learned counsel for the petitioner submits that the petitioner and O.P. No.2 is husband and wife and on the joint prayer of the both parties, the matter was referred to the Mediation Centre, Patna High Court, where both the parties have settled their dispute and they decided to lead their conjugal life to each other. Further submission is that both the parties have also entered in an agreement dated 17.08.2017, which is the part of the report dated 21.08.2017 of Mediator, Mediation Centre, Patna High Court. Patna High Court Cr.Misc. No.52842 of 2016 (5) dt.23-08-2017 2/2 dated 21.08.2017 shows that petitioner and O.P. No.2, who are husband and wife, have settled their dispute and they decided to lead conjugal life.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Mali P.S. Case No. 36 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
