2. The petition for the grant of anticipatory bail in connection with Raxaul P.S. Case No. 337 of 2025, dated 01.08.2025, registered for the offences under Sections 126(2),

Patna High Court CR. MISC. No.42947 of 2026(2) dt.13-07-2026 2/3 115(2), 118(1), 109, 352, 351(2) and 3(5) of the B.N.S.

3. The case of the prosecution, in short is that the informant, namely Ajay Paswan, who is an auto rikshaw driver returned home and saw that all the accused persons named in the F.I.R., including the petitioners were assaulting his son with lathis who has sustained injury over head. Upon intervening, the informant and his brother, namely, Sanjay Paswan has been assaulted and other family members were also assaulted which resulted into injuries.

4. Counsel for the petitioner submits that the petitioners have been falsely implicated due to passage dispute resulting in an omnibus allegation against eleven members of the same family. The attention of this Court has been further drawn towards Paragraph-7 of the impugned order, wherein the court below has mentioned all the injuries are simple in nature.

5. The counsel for the State opposes the anticipatory bail.

6. Having considered the rival submissions, particularly the injuries sustained by the injured on the informant's side are simple in nature, as surfaced in the impugned itself, and petitioners possess clean antecedent, this Court is inclined to allow the prayer.

7. Let the petitioners, above named, in the event of arrest and surrender before the below Court within a period of four weeks from today, after furnishing the bail bond of Rs. Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Raxaul at Motihari, East Champaran, in connection with Raxaul P.S. Case No. 337/2025.
