JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Simari P.S. Case No. 205 of 2014 registered under Sections 341, 323, 379, 384, 504 and 506/34 of the Indian Penal Code. Petitioner is named in the First Information Report but the specific allegation of snatching motor-cycle, cash and documents of the informant is against co-accused Vijendra Kuwar, who has already been admitted to anticipatory bail by a co-ordinate Bench of this Court. So far as the petitioner is concerned, no specific allegation has been attributed against him.

Although, petitioner does have criminal antecedent,

Patna High Court Cr.Misc. No.43500 of 2016 (2) dt.29-11-2016 2/2 but taking note of the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioner named above, in the event of his arrest or surrender in the court below within four weeks from the date of receipt / production of copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Simari P.S. Case No. 205 of 2014 to the satisfaction of learned Chief Judicial Magistrate, Buxar subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
