JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 01-11-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Ramgarh P.S. Case No. 215 of 2017, registered under Sections 147, 149, 341, 323, 354, 379, 307, 436, 504, 427 and 506 of the Indian Penal Code.
The accusation is that, on 18.08.2017, due to land dispute, Ramdhin Ram (petitioner no. 1), Bhanu Ram (petitioner no. 2) and Sonu Ram (petitioner no. 3) started to abuse and caused assault at the head of informant, Mantra Devi through lathi. At that time, Chanpati Devi (petitioner no. 4), Ghudur Ram
(petitioner no. 5), Marachhi Devi (petitioner no. 6), Surendra Ram (petitioner no. 7) and Jitendra Ram (petitioner no. 8) called the father of the informant then Santra Devi, sister and mother of the informant, Chanrawati Devi, came out to the house then they were also assaulted by the accused persons, in which, Santra Devi, sustained injury. At that time, they also snatched the gold chain of Santra Devi, sister of the informant. Learned counsel for the petitioners submits that occurrence took place due to land dispute, in which, petitioners' side also sustained injury, regarding which, Ramgarh P.S. Case No. 216 of 2017 is also instituted on the basis of written report of co-accused, Ram Adhin Ram. Moreover, injuries, as found on the person of the informant and her sister Santra Devi, are simple in nature.
Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Kaimur at Bhabua, in connection with Ramgarh P.S. Case No. 215 of 2017, subject to the condition as laid down
under Section 438(2) of the Cr.P.C.
