The petitioner is in custody in connection with Mohania P.S. Case No. 163 of 2019 for the offenses under Section 379 of the Indian Penal Code.
Learned counsel for the petitioner submits that no case is made out against the petitioner. His name surfaced merely on the basis of confessional statement of the co-accused. He further submits that petitioner is not named in the FIR. He has no criminal antecedent. The petitioner is in custody since 18.04.2019.
Considering the fact that the petitioner is not named in the FIR and also has no criminal antecedent, the Court is inclined to grant him bail. Let the petitioner, above named, be
