This is the second attempt of the petitioner, who is husband, for seeking bail as his bail application was earlier rejected by the order dated 05.02.2020 in Cr. Misc. No.67996 of 2019 (Annexure-1).
Accordingly, by order dated 09.02.2022, a report was called for from the learned Court below. The report has been received vide letter no.16 dated 18.02.2022 issued by the Additional District & Sessions Judge-XIII, Begusarai. From perusal of the report, it appears that till date, the case is being taken up based on the appearance of the petitioner from jail.

Considering the period of custody and the present status of the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Barauni in connection with Barauni P. S. Case No.191 of 2019. The application stands allowed.
However, if the learned Court below is of the view that the trial is being delayed at the instance of the petitioner, the learned Court below shall forthwith cancel his bail bonds. (Satyavrat Verma, J) vikash/- U T
