1. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of (Barachatti) Mohanpur Police Station Case No. 297 of 2024, dated 19.10.2024, disclosing offences under Sections 126(2)/ 115(2)/ 118(1) /117(2) /109(1)/ 303(2)/ 352/ 351(2)/ 3(5) of the Bhartiya Nyaya Sanhita.

3. The prosecution case, as per the First Information Report, is that on 19.10.2024, the petitioner no. 1 assaulted the informant by means of pasuli due to which he sustained injury on his hand. Petitioner no. 2 assaulted by means of lathi on the leg of the informant.

4. Learned counsel for the petitioners submits that the informant runs a small grocery shop in the market and adjacent to his shop, the petitioner runs his grocery shop and near their shops there is vacant land of the informant. On the date of incident, somebody threw garbage on the vacant land due to which hot discussion took place between the parties and during the scuffle the informant sustained minor scratch on his head. He next submits that during the course of investigation, it has come to light that injury caused to the informant in simple in nature.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation and the fact that informant has sustained simple injury, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate II, Sherghati, Gaya, in
