No one appears for the State.

The petitioner is seeking regular bail in Hajipur Town P.S. Case No. 274/2017 registered under Section 394 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R., he has been falsely implicated in this case once he was made accused in Hajipur Town P.S. Case No. 269/2017. Learned counsel submits that the petitioner is in custody since 30.05.2017, nothing incriminating has been recovered from his possession and no T.I. Parade has been conducted till date to identify the accused. He submits that it is a case of false implication. Learned counsel also submits that the name of this petitioner has transpired in the confessional statement

Patna High Court Cr.Misc. No.4383 of 2018 (2) dt.01-02-2018 2/2 of co-accused Mamua, who has been granted regular bail by a coordinate bench of this Court. In the facts and circumstances, let the petitioner, named above, be released on bail on his furnishing bail bonds of Rs. 15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 274/2017, subject to the conditions as laid down under Section 437(3) Cr.P.C. and that the petitioner shall not indulge in similar kind of offence and shall cooperate in course of investigation as well as trial and two consecutive failures to put his appearance in course of trial would invite cancellation of bail.
