JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 The petitioner seeks regular bail in connection with Charpokhari P.S. Case No. 107 of 2015, registered for offences punishable under Sections 147, 148, 149, 323, 307, 353, 337, 338, 504 and 506 of the Indian Penal Code.

Allegation as per F.I.R. is that while the police had gone to arrest an accused in village Charpokhari, 100-150 people assembled and started abusing the police personnel and also pelted bricks and stones, causing injuries to three police personnel. Apart from that it appears that petitioner is an accused in fourteen other cases.

It has been submitted on behalf of the petitioner that large number of persons have been made accused in this case and no specific allegation has been attributed to the petitioner.

Patna High Court Cr.Misc. No.66529 of 2018(4) dt.20-12-2018 2/2 Further submission is that although he is accused in fourteen other cases but in all those cases, he is on bail and in this case he has been in judicial custody since 19.01.2017. Heard learned A.P.P. also.

Having heard both sides, no doubt petitioner is an accused in several other cases, however in the present case, no specific allegation has been attributed to him, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara, in connection with Charpokhari P.S. Case No. 107 of 2015, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
