JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-11-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 447, 323, 325, 308, 504, 506, 379 of the Indian Penal Code.

The prosecution case is that the petitioner along with others assaulted the informant and his brother. It is further alleged that co-accused Budha Deo Rai took Rs. 5000/- kept in a bag. It is specifically alleged against the petitioner that he assaulted with khanti to the informant. It is submitted by learned counsel for the petitioner that injury has been found to be superficial, simple in nature caused by hard and blunt substance. Moreover for the occurrence of 03.09.2015, the First Information Report was registered on 05.09.2015. There is counter version of the occurrence also.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Koilwar P.S. Case No. 197 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
