JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 19-11-2016 Heard Mr. Amarendra Kumar, counsel for the petitioner and Mr. Mukeshwar Dayal, APP for the State. The petitioner, apprehending his arrest in Jainagar P.S. case No.219 of 2015 registered under Sections 323, 341, 353 and 379 I.P.C., prays for grant of anticipatory bail. The Headmaster of the School lodged the case that while he was engaged in distributing scholarship, the petitioner came and snatched Rs.50,000/- and counterfoil of the receipts and thereby obstructed in due discharge of official duty. Referring to Annexure-2 it is stated that the police found the allegation of snatching the cash amount and counterfoil not substantiated during investigation and, as such, charge-sheet under Section 353 I.P.C. has only been filed. The petitioner is elected Ward Member having no criminal antecedents.

No.40112 of 2016 (3) dt.19-11-2016 2/2 Considering the above, let the petitioner above named be released on anticipatory bail in the event of arrest/surrender before the learned court below within a period of four weeks from today on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Madhubani in connection with Jainagar P.S. case No.219 of 2015 corresponding to G.R. No.2587 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure with the further following conditions: (i) One of the bailers shall be the own/close family members of the petitioner.

(ii) In case of framing of charge, the petitioner shall appear in person on each and every date fixed in the Court below. In case of default in doing so on two consecutive occasions without any cogent/satisfactory reason, the Trial Court shall have liberty to cancel the bail bond of the petitioner and secure his arrest in accordance with law.
