The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, about 2351 litres of IMFL was recovered from the field and one accused Robin Kumar was arrested while others managed to flee away. It is submitted by learned counsel for the petitioner that neither the petitioner is named in the FIR nor any incriminating article has been recovered from his possession. The name of the petitioner transpired in course of investigation on the information received from spy that the petitioner was in contact with the accused persons involved in the trade of liquor.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case specially the petitioner not having any criminal antecedent and having remained in custody for over 9 months, the petitioner is directed to be enlarged on bail in connection with Ballia P.S. Case no. 105 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge II - cum - Special Judge, Excise, Begusarai.
