1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Section 120(B)/ 34 of the I.P.C. and Sections 25(1-AA), 26(i)ii) and 35 of the Arms Act.

3. The learned counsel for the petitioner submits that the petitioner is in custody since 29.09.2023, he is a person with clean antecedent. It is next submitted that illegal arms are alleged to have been manufactured in a house of which petitioner is the owner. It is also alleged that his son escaped from the place of occurrence and 27 semi prepared country-made pistol were recovered.

The learned counsel for the petitioner submits that petitioner had given the house on rent to one Ajay Kumar and in support of the same, relies on a rent agreement and the electricity bill in name of Ajay Kumar as would manifest from Annexures-3 and 4. It is also submitted that charge-sheet has been submitted and petitioner will not abscond rather will cooperate in the trial to prove his innocence.

5. Learned A.P.P. opposes the bail application.

Considering the submissions made by the learned counsel appearing on behalf of the petitioner and the fact that petitioner is a person with clean antecedent, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II, Patna in connection with Sessions Trial No.383 of 2024 arising out of Nadi P. S. Case No.177 of 2021.

7. The application stands allowed.

8. However, in the event, if the learned trial Court comes to a conclusion that the petitioner after his release is
