JUSTICE BIRENDRA KUMAR ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468 and 406 of the Indian Penal Code.

The complainant is agent of OCPL Company.

Allegation is that he had deposited insurance premium of different premium holder. Receipt was granted of the deposit. However, the original bond paper was not handed over. The complainant found to be cheated. The petitioner was employee of the company and submission is that some other cases were also lodged for the same grievance and the petitioner has already been granted anticipatory

Patna High Court Cr.Misc. No.52983 of 2016 (2) dt.21-12-2016 2/2 bail in Cr. Misc. No. 26829 of 2016 on 04.07.2016. Moreover, in the present case also some other co-accused have been granted anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 37559 of 2016 on 21.09.2016.

Considering the aforesaid fact, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad (Bihar)/Successor Court in connection with Aurangabad (Town) Police Station Case No. 339 of 2011, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
