JUSTICE MADHURESH PRASAD ORAL ORDER 10-10-2018 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner's prayer for bail was earlier rejected by this Court vide order dated5.4.2018, passed in Cr.Misc.No. 12610 of 2018.. Petitioner is an accused in a case registered for offence under sections 307/34/120B, 302/120B IPC and under section 27 of the Arms Act.

Learned counsel for the petitioner submits that coaccused Raushan Kumar against whom there is a similar allegation of being a contract killer in the instant occurrence was allowed bail in Cr.Misc.No.63729 of 2017. The said order however could not be brought to the notice of the Court on the earlier occasion when petitioner's prayer for bail was rejected under order dated

Patna High Court Cr.Misc. No.51567 of 2018 (3) dt.10-10-2018 2/2 5.4.2018. In view of the aforesaid submission, learned counsel for the petitioner claims parity with co-accused Raushan Kumar in the matter of grant of bail.

Learned counsel for the State has opposed the prayer for bail.

Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge I, Jehanabad in Karpi Police Station Case No. 145 of 2017, Sessions Trial No. 681 of 18/83 of 18 on the following conditions:- One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

The Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
