JUSTICE ARUN KUMAR ORAL ORDER 11-10-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner, already in custody, seeks bail in connection with Chhatauni P.S. Case No.66 of 2017, registered under Sections 30(A) and 37(d) of the Bihar Prohibition and Excise Act. Allegation in brief is that total 6480 ml. of foreign liquor was recovered from the house of the three accused persons. Learned counsel for the petitioner submits that other co-accused Shivnath Prasad has been admitted to bail by a coordinate Bench of this Court vide Cr. Misc. No.24818 of 2017 on 31.05.2017, the case of the petitioner stands on similar footing and he has been in custody since 18.03.2017 and he has no any type of criminal antecedent.
Having considered the said facts and circumstances,
Patna High Court Cr.Misc. No.47579 of 2017 (2) dt.11-10-2017 2 /2 let petitioner, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 7th Additional Sessions Judge-cum-Special Judge, Excise Act, East Champaran, Motihari in connection with Chhatauni P.S.
