JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2017 The petitioner seeks regular bail in connection with Aurangabad (M) P.S. Case No. 78 of 2016, registered for offences punishable under Section 392 of the Indian Penal Code. Allegation against the petitioner is of committing loot of Rs. 5500/- one mobile and a motorcycle from the informant. It has been submitted on behalf of the petitioner that he has not been named in the F.I.R and save and except the confession made by the accused person, there is absolutely nothing against the petitioner so as to show his involvement in this case and further no recovery has been made and he has been in custody since 22.08.2016.

Heard learned A.P.P. also.

Having heard both sides, though petitioner is accused in

four other cases but in this case, except confession, there is nothing against the petitioner, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad (M) P.S. Case No. 78 of 2016, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner has to appear before the local police station of his area in the first week of each month at least for a period of one year so that the police may watch his conduct during the aforesaid period.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the

prosecution is free to move for cancellation of his bail.

Let a copy of this order be communicated to the S.P. of concerned district so as to ensure that petitioner shall comply the above direction.
