This application is for grant of regular bail in connection with Barauni Rail P.S.case No.67 of 2002 for the offences under Sections 302/34 of the Indian Penal Code. Petitioner is named in the FIR. The case is of the year, 2002 . It further appears that the petitioner has been declared absconder by the court on 13.10.2017 and thereafter he surrendered in the court on 23.2.2018.

Submission of the learned counsel for the petitioner is that he has no knowledge about the case and as such he could not appear earlier and there is no allegation of any overt act against this petitioner.

Heard learned A.P.P. also.

No.55944 of 2018 (5) dt.20-11-2018 2/2 Having heard both sides and in view of the fact that the petitioner was absconder and the case is of the year, 2002 and it has been informed that the charges have been framed as such, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and for that purpose, the learned trial court desires to have LCR of Criminal Appeal No.379 of 2008 from this Court and the same may be returned to the learned trial court with direction that once the trial is concluded he shall return the LCR to this Court. The learned trial court is further directed to conclude the trial within a period of six months from the date of receipt of the order by conducting it on regular basis.

With the aforesaid observation, this application is dismissed.
