The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 21(c) and 22(a) of the NDPS Act and Section 18 (c) of the Drugs Cosmetic Act.

As per prosecution case, the informant stated a huge quantity of CODINE based cough syrup and NITRAVET -10 tablets, as mentioned in the seizure list were seized, which is Psychotropic Drugs.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that Raj Medico owned by this petitioner and is a legal Medical shop having valid and proper license of sale and

No.52284 of 2021(2) dt.06-04-2022 2/2 distribution of medicines and the owner of the shop had applied for renewed of license and deposited required fees on 08.06.2021 from 11.04.2021 to 10.04.2026 and the shop in question was also registered under GST and the application for renewal of license has already been approved by the department and ordered the license till 10.04.2026. Petitioner has got clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, East Champaran, Motihari in connection with NDPS Case No. 49 of 2021 arising out of Raxaul (Haraiya) P.S. Case No. 205 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
