JUSTICE MOHIT KUMAR SHAH ORAL ORDER 12-01-2021 The present petition has been filed for restoration of a petition bearing Criminal Misc. No. 441 of 2020, which had stood dismissed on account of non-compliance of the peremptory order dated 13.01.2020 regarding removal of the defects.
The learned counsel for the petitioner submits that though the defects have been removed, however, the Registry has considered the defects to have not been removed inasmuch as in the supplementary affidavit filed on behalf of the petitioner, i.e. by the deponent Umaravati Devi, her name has been typed as 'Umaravati', on the 1st page of the said supplementary affidavit, instead of 'Umaravati Devi'.
Patna High Court CR. MISC. No.40938 of 2020(2) dt.12-01-2021 2/2 Having regard to the submissions of the learned counsel for the petitioner and having examined the records, the aforesaid defect is ignored and the petition bearing Criminal Misc. No. 441 of 2020 stands restored to its original file, however, subject to removal of other defects, if any. The present petition stands allowed.
The Registry is directed to list the original petition expeditiously.
