The petitioner is apprehending his arrest in a case registered under Sections 409, 420 and 384 of the Indian Penal Code.
Allegation is that the accused persons including the petitioner have appointed another person on place of the informant by doing manipulation in the document and getting Rs.3 lacs. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. From perusal of the order of the Sessions Judge, it is evident that no
Patna High Court Cr.Misc. No.50333 of 2016 (3) dt.25-11-2016 2/2 specific allegation has been made against the petitioner for demand of money. The main allegation has been made against the Panchayat Secretary, namely, Subodh Singh, who was demanding money for issuing the appointment letter of the informant. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sheohar in connection with Purnahiya P.S. case No.01 of 2011, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
