====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 22-04-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Obra P.S. Case No. 167/2020 registered for the offences punishable under Sections 341, 323, 498(A), 494/34 of the Indian Penal Code 1860 and Section 3/4 of Dowry Prohibition Act.

As per the First Information Report the marriage of the petitioner was solemnized with the informant in the year 2015 and the allegation is that the petitioner along with other family members demanded dowry and due to nonfulfillment of the said demand, they physically and mentally

Patna High Court CR. MISC. No.52152 of 2021(2) dt.22-04-2022 2/3 tortured the informant and ousted her from the matrimonial home. It has further been alleged that the petitioner has performed second marriage.

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case with oblique motive. He further submits that the allegation against the petitioner and other family members is general and omnibus in nature and the petitioner has not solemnized second marriage as alleged. He next submits that the petitioner is in custody since 11.7.2021, charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence. Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that the petitioner is in custody since 11.7.2021, charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be

Patna High Court CR. MISC. No.52152 of 2021(2) dt.22-04-2022 3/3 released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Daudnagar, in connection with Obra P.S. Case No. 167/2020.
