Mr. Binod Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RITESH KUMAR ORAL ORDER 01-07-2026 Heard the learned counsel for the petitioner and the learned A.P.P. appearing on behalf of the State.

2. The petitioner apprehends his arrest in connection with Hajipur Town P.S. Case No. 1153 of 2025 for allegedly having committed offences under Sections 115(2), 352, 308(2), 308(5), 336(1), 335, 336(3), 340(2) and 140 of B.N.S., 2023.

As per the prosecution story, which has been lodged on the basis of a complaint case filed by the complainant before the court of the learned Chief Judicial Magistrate, Vaishali at Hajipur, which was numbered as Complaint Case No.1193 of 2025, to the effect that the accused person are criminals and their business is to kidnap and collect ransom. It has been alleged that on the date of occurrence, co-accused along with six

2/4 unknown persons kidnapped the informant/complainant from his house and brought him at Tangaul where the petitioner and co-accused, Ranjit Das were sitting. They forcefully took thumb impression and signature of the informant/complainant on a stamp paper and prepared an agreement for sale of the land in their names and further demanded Rs. 30,00,000/- as ransom. On the basis of the complaint filed by the informant/complainant, the same was sent to the concerned police station under Section 175(3) of B.N.S.S., which gave rise to Hajipur Town P.S. Case No.1153 of 2025.

4. The learned counsel for the petitioner submits that the entire allegation levelled against the petitioner and others in the complaint petition are entirely false and concocted. He submits that an application was submitted by the informant/complainant on 17.07.2025 before the concerned police station and thereafter the complaint case was filed on 08.09.2025. He submits that the informant/complainant is a land broker and the petitioner purchased a land bearing Khata No.328, Plot No.1371 having an area of 5 decimals in 2016 in the name of her mother and sister through a registered sale deed, which was executed by Sujeet Kumar. The said land was again sold by one Punam Devi and Manni Devi in the year 2023 and

3/4 the informant/complainant of the present case is the broker in the said land deal. Due to subsequent registration of the said land, the mutation could not take place in the name of mother and sister of the petitioner. He further submits that the petitioner is an accused in one another case bearing Hajipur Town P.S. Case No.632 of 2025, in which he is on bail.

5. Per Contra, the learned APP appearing on behalf of the State opposes the prayer for grant of anticipatory bail to the petitioner and submits that the petitioner kidnapped the informant/complainant and is an accused in one another case.

Having considered the rival submissions and after going through the records, it appears that there is a dispute with regard to execution of sale deed and the allegation is with regard to taking signature of the informant/complainant on some stamp paper. Further, the land, which was purchased by the mother and sister of the informant/complainant, was again sold in collusion with the informant/complainant. Further, the dispute appears to be civil in nature for which the present criminal case has been filed.

7. Taking into consideration the facts aforesaid, let petitioner, above-named, in the event of his arrest or surrender within a period of six weeks, be released on bail on furnishing

4/4 bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No.1153 of 2025, subject to the conditions laid down under Section 482(2) of the B.N.S.S with a further condition that:- The learned court concerned shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court concerned shall take steps for cancellation of his bail bond. However, the acceptance of bail bond in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
