JUSTICE HARISH KUMAR ORAL JUDGMENT Date : 20-12-2022 Heard Mr. Ranjan Kumar Dubey, learned counsel for the petitioner, Mr. Ritesh Kumar, learned counsel for the respondent Veer Kunwar Singh University and Ms. Namrata Singh, learned AC to GA 12.

In compliance of the order dated 06.12.2022, a supplementary counter affidavit has been filed on behalf of the respondent no.1, wherein a categorical assertion has been made in paragraph no.8, that the Department vide letter contained in Memo No.3789 dated 09.12.2022 has directed the Registrar of the respondent Veer Kunwar Singh University, Ara to make payment

Patna High Court CWJC No.1596 of 2021 dt.20-12-2022 2/3 to the petitioner without any delay from the available fund with the university, in accordance with law.

Mr. Ritesh Kumar, learned counsel for the University submits that as the respondent State authorities has already directed to ensure the payment to the petitioner from the available fund with the university, the same would be done within a period of two weeks. He also submits that the admissible dues of the petitioner has been calculated, which comes to Rs.3,41,726/-.

4. At this juncture, Mr. Ranjan Kumar Dubey, learned counsel for the petitioner submits that the petitioner is also entitled for interest over the delayed payment of gratuity as well as differences of arrears of pension on account of 7th pay revision.

5. In view of the aforesaid submission made on behalf of the learned counsels for the parties, the present writ application stands disposed of with a direction to the respondent Veer Kunwar Singh University to ensure the payment of all the remaining admissible dues of the petitioner under the head of gratuity as well as arrears of difference of pension on account of 7th pay revision, within the period as stated above.

6. It is needless to say that if the petitioner is found entitled for interest over the delayed payment as stated to have
