The petitioner has preferred this application for grant of regular bail in a case registered under sections 414 and 34 of the Indian Penal Code and sections 8 and 20(b)(ii)(c) of the NDPS Act.

As per the prosecution case, 9.420 kgs of ganja was recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. He is in custody since 27.7.2020 and has no criminal antecedent under the NDPS Act. It is further submitted that coaccused

Patna High Court CR. MISC. No.52475 of 2021(26) dt.10-03-2022 2/2 Rahul Jaikar has been enlarged on bail vide order dated 28.2.2022 passed in Cr. Misc. no.44440 of 2021. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 7 months, the Court directs the petitioner to be enlarged on bail in connection with Special Case no. 108 of 2020 (arising out of Paliganj P.S. Case no.244 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge/Special Judge, Patna.
