====================================================== CORAM: HONOURABLE MR. JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 20-11-2025 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in connection with Amnour P.S. Case No. 377 of 2022, instituted for the offences punishable under Sections 272, 273, 328, 307, 304 and 120/34 of the Indian Penal Code and Section 30(a), 37(b), 33 and 34 of the Bihar Prohibition and Excise Act.

3. The prosecution case, in short, is that Police got information that persons are dying on account of consumption of spurious liquor.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. No incriminating material has been

Patna High Court CR. MISC. No.44841 of 2025(6) dt.20-11-2025 2/3 recovered from the conscious possession of the petitioner. The petitioner has got no concern with the alleged recovery of liquor. The petitioner is not named in the F.I.R. The name of the petitioner has been disclosed by co-accused Suraj Kumar in connection with Ishupur P.S. Case No. 280 of 2022. The petitioner is in custody since 31.05.2025 and has got one criminal antecedent. There is no compliance of Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023.

5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner. The petitioner is involved in selling of spurious liquor due to which four persons died. It has been stated in para-158 of the case diary that petitioner used to receive spirit from transporter for Homeopathy medicine. The petitioner along with co-accused Sanjeev Kumar and his brother Rajeev Srivastava was involved in this business. He further submitted that petitioner has also confessed his guilt in this case. The petitioner is the driver of Rajesh @ Doctor and on his instruction petitioner used to carry spirit.

7. Considering the aforesaid facts and
