JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 16-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner prays for grant of anticipatory bail in Khagaria Muffasil P.S. Case No.465 of 2016 registered under Sections 467, 468, 420, 471, 120(B)/34 of the Indian Penal Code. The Inspector of Vigilance lodged the case on the written petition of the informant that the petitioner obtained job of Primary teacher on contract basis on the basis of fake certificates. It is submitted by the learned counsel for the petitioner that the institutions from which the petitioner obtained the certificates had some affiliation or recognition by the Central

For securing the privilege of bail the petitioner is willing to deposit her salary of two months with the Government or informant without being prejudiced which shall further not prejudice right of contention of the case.

It is stated that few co-accused carrying identical allegations have been extended the privilege of anticipatory bail vide order dated 26.10.2016 passed in Cr.Misc. No.43376 of 2016. Considering the above, in the event of arrest or surrender in the court below within four weeks, the petitioner above named is directed to be released on anticipatory bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria, in Khagaria Muffasil P.S. Case No.465 of 2016, G.R.No.1579/16 subject to the condition as laid down under Section 438(2) of the Cr.P.C. with the further following conditions: (i) One of the bailers shall be the own/close family members of the petitioner.

(ii) In case of framing of charge, the petitioner shall appear in person on each and every date fixed in the court below.

Patna High Court Cr.Misc. No.48611 of 2016 (2) dt.16-12-2916 3/3 In case of default in doing so on two consecutive occasions without any cogent/satisfactory reason, the Trial Court shall have liberty to cancel the bail bond of the petitioner and secure his arrest in accordance with law.

(iii) Along with bail bond the petitioner shall produce a receipt of deposit a sum of Rs.20,000/- in the office of the concerneed District Programme Officer or District Education Officer or concerned appropriate authority.
