2. Learned counsel for the petitioner submits that the present interlocutory application has been filed seeking permission to withdraw the present writ petition with liberty to file the case before the ESI Tribunal, Patna.

3. Learned counsel appearing on behalf of the ESIC submits that if the petitioner is inclined to withdraw the present writ petition, he has no objection, however, for the purpose of

Patna High Court CWJC No.15679 of 2019(12) dt.23-03-2026 2/2 seeking liberty to approach the ESI Tribunal, the petitioner may be directed to deposit the appropriate court fee for availing the said remedy.

4. In light of the request made by learned counsel for the petitioner, I.A. No. 01 of 2026 is hereby allowed. Permission is granted to withdraw the present writ petition. In case the petitioner files any case before the ESI Tribunal/ESI Court under Section 75 of the ESI Act, 1948, he shall deposit the requisite court fee before the Tribunal. If the said Tribunal does not have an account for deposit of the court fee, the petitioner shall deposit the said court fee with the ESIC, as contemplated under Section 75(2B) of the ESI Act, 1948.
