The petitioner apprehends his arrest in Supaul Mahila P.S. Case No. 56/2016, registered for the offences punishable under Sections 376 and 506 of the Indian Penal Code. The prosecutrix alleged that while she was grazing her cattle, the petitioner came there and committed rape with her. When Sudama Devi came to rescue the prosecutrix the petitioner fled away.

Learned counsel for the petitioner submits that the allegation is false and concocted. Jaila Devi filed S.C./S.T. P.S. Case No. 21/2016 against the husband and other family members of the informant and that is why the present case has been filed. It appears that S.C./S.T. case was registered on

Patna High Court Cr.Misc. No.39954 of 2016 (4) dt.18-11-2016 2/2 11.07.2016 alleging therein that the accused persons assaulted the informant and others, whereas, the present case was registered on the same day that the petitioner committed rape with the victim. Considering the facts aforesaid and nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
