1. Heard learned counsel for the petitioner and learned APP for the State.
2. A prayer for bail has been made on behalf of the petitioner in connection with Buniyad Ganj P.S. Case no.284 of 2024 registered under sections 132, 262 and 263 of the B.N.S, 2023 and Sections 30(a) and 45 of the Bihar Prohibition and Excise Act.
3. Learned counsel for the petitioner submits that petitioner had already been granted privilege of anticipatory bail in this case on merit vide order dated 18.04.2025 passed in Cr. Misc. No. 5644 of 2025 and a copy of the same has been annexed as Annexure-1 of the supplementary affidavit. She further submits that when condition of verification of criminal antecedent of the petitioner was done, it was found that the petitioner was an accused in a total of four cases as against which three cases had been stated in the anticipatory bail
Patna High Court CR. MISC. No.41544 of 2025(2) dt.11-07-2025 2/2 petition and this is the reason why the bail bonds of the petitioner was not accepted and hence, this regular bail application was moved. She further submits that the petitioner is now languishing in jail since 08.05.2025 and undertakes to cooperate in investigation/trial.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.
6. Taking into consideration the above mentioned facts of the case, the petitioner is directed to be enlarged on bail in connection with Buniyad Ganj P.S. Case no.284 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court on the condition that the petitioner would co-operate in investigation/trial and shall remain present in Court on each and every date till framing of charge and in the event of failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court below.
