JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-07-2019 This is an application for grant of anticipatory bail in connection with Buxar (Muffasil) P.S. Case No.107 of 2019 disclosing offences under Sections 414, 420 of the Indian Penal Code and Section 11 of Gambling Act.
Prosecution story is that on a secret informant that a gambling is going on, the police personnel raided the place of occurrence, on seeing the police, 10-15 persons succeeded in fleeing away and one accused Vikas Kumar Dubey has been arrested and he disclosed the names of other accused persons, as his accomplishes.
Submission of the learned counsel for the petitioners is that they have been arrested on the basis of confessional statement of co-accused, but there is no other material available
Patna High Court CR. MISC. No.40231 of 2019(2) dt.01-07-2019 2/2 against them and they have no criminal antecedent. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Buxar (Muffasil) P.S. Case No.107 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with further condition that if in future their names again transpires in such type of case, the prosecution is at liberty to move for cancellation of the bail bonds of the petitioners.
Let a copy of this order be sent to the Superintendent of Police, Buxar, for needful.
