Petitioner seeks bail in Dulhin Bazar P.S. Case No.82 of 2018 instituted for the offence under Section(s) 354, 506 Indian Penal Code and Section 8/12 of the POCSO Act. Counsel for the petitioner submits that there is general and omnibus allegation against the petitioner, who is in custody since 17.07.2018.
In the written report as well as in the statement of the victim recorded under Section 164 Cr.P.C., it is alleged that while daughter of the informant was sleeping on the roof, this petitioner tried to misbehave with her. It is mentioned in the written report that petitioner was not found at the place of occurrence.
