ANJANA MISHRA ORAL ORDER 09-11-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is in custody since 20.07.2017 in connection with a case registered for the offences punishable under Sections 387 of the Indian Penal Code and Section 4/5 of the Explosive Substance Act.
Learned counsel for the petitioner submits that neither he is named in the First Information Report nor was he arrested at the spot. He further submits that the extortion call to the informant had also not come form the petitioner's mobile phone number and, therefore, he has been named on the confessional statement made before the police by co-accused Shatrughan Sah which has no evidentiary value.

No.51858 of 2017 (2) dt.09-11-2017 2/2 Considering the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1, East Champaran, Motihari, in connection with Govindganj (Malahi) P.S. Case No. 166 of 2017.
