The petitioner apprehends his arrest in Riga P.S. Case No. 303/2015 registered under Section 307 and other sections of the Indian Penal Code.
The informant alleged that while he along with Ram Ayodhya Singh was returning on a motorcycle from Sitamarhi, the petitioner and other accused persons surrounded the informant and Ram Ayodhya Singh. The accused persons pushed them and thereafter the petitioner assaulted him with knife on his head and also snatched money from the possession of the informant. Learned counsel for the petitioner submits that there is a counter-version being Riga P.S. Case No. 300/15 in which the shop of the petitioner was burnt to ashes by the informant and others. One sharp cut injury was found on the person of the informant which is alleged to have been caused by the petitioner
Patna High Court Cr.Misc. No.39424 of 2016 (3) dt.18-10-2016 2/2 but there is no piercing injury.
It appears that the police after investigation found the case lodged by the petitioner false and the present case was found to be true. The petitioner is alleged to have assaulted the informant with knife on his head and corresponding injury was found. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in Riga P.S. Case No. 303 of 2015. Accordingly, the same is rejected.
