The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, while the accused persons managed to escape, 50 litres of liquor was recovered from the motorcycle which was abandoned. The petitioner was identified by the local person as one of the accused who had escaped.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case by his enemies because of his antecedent. No incriminating article has

Patna High Court CR. MISC. No. 52898 of 2021(2) dt.03-02-2022 2/2 been recovered from his possession. He is in custody since 9.8.2021 and chargesheet has been submitted in the case. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case and the petitioner not having been arrested at the spot, the Court directs the petitioner to be enlarged on bail in connection with Kothi P.S. Case no.40 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge, Excise Act, Gaya.
