The petitioner is languishing in custody since 20.04.2018 in a case registered for the offences punishable under Sections 457, 380 and 411 of the I.P.C. The prosecution case as per the written report of Ranjit Kumar Chaudhury submitted to the S.H.O., Alamganj P.S., is to the effect that 19.04.2018 at about 06.00 A.M. when the informant open his office, he found that computers, U.P.S., mouse and keyboards which the informant used on 18.04.2018 at 06.30 P.M., are missing from the office.

No.66508 of 2018(4) dt.23-01-2019 2/3 It appears that the learned Additional Sessions Judge after going through the case diary found that from the terrace of the house of the petitioner the U.P.S., Monitor were recovered. It is submitted by learned counsel for the petitioner that in fact the recovery was made from the house of the petitioner but due to previous dispute, the petitioner has been roped in the present case. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP submits that the recovery was made from the house of the petitioner.

Considering the fact that the order of learned A.C.J.M.-II, Patna City reflects that trial is not likely to be concluded shortly as only one witness has been examined so far, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Patna City in connection with Alamganj P.S. Case No.179 of 2018. One of the bailors shall be close family members of the petitioner and the other bailor shall be a government servant.
