JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 404(C) of 2017 in which cognizance has been taken under Section 420 IPC. As per complaint petition, petitioner has taken Rs.2.65 lac from the complainant on the assurance that he will return the same but he has not returned the money and later on he has made an agreement with wife of complainant.

Submission of learned counsel for the petitioner is that there is no chit of paper available on the record to show that complainant has given money to him and so far agreement is concerned, the same is between the wife of complainant and not with the complainant.

In view of above facts and circumstances, the provisional bail granted to the petitioner by order dated 9.7.2019 is confirmed.
